Termite Terms and Conditions:
This agreement is being made between Customer and On the Fly Pest Solutions, Inc.
Prior to services, customer is responsible to fully disclose any and all information that is relevant to the construction of the structure including, but not limited to, the existence of wells, cisterns, plenum, crawlspaces, embedded duct work, concealed pipes or cables drainage systems, etc. Failure to divulge information such as noted above shall fully release On the Fly Pest Solutions, Inc. from any and all liabilities arising out of this agreement.
Warranty Fee & Inspection:
On the Fly Pest Solutions, Inc. will extend service to the customer for as long as customer owns property and account is current. Any accounts in default will void the warranty.
Conditions Conducive to Infestation:
Customer agrees, during the terms of this agreement, to maintain the structure(s) and keep the treated area free from any conditions conducive to infestation such as wood to ground contact, foam boards, excessive moisture, debris under or around structure, grade level too high, heavy foliage, poor drainage, insufficient ventilation, stucco, ridge foam board and/or expanded foam materials which are in contact with the soil. Customer also agrees to notify On the Fly Pest Solutions, Inc. of and eliminate faulty plumbing and/or leaks from gutters, drains, and down spouts etc.
Additions and/or Alterations:
In the event of additions or alterations to the premises, customer must give prior notice and arrange with On the Fly Pest Solutions, Inc. for additional services at the customer’s expense.
Non-Payment:
The customer agrees that upon default of any payment, On the Fly Pest Solutions, Inc. is relieved from further obligation under this agreement, and shall be entitled to any remedies available at law, in equity, and pursuant to these terms and conditions. All remedies available to On the Fly Pest Solutions, Inc. shall be cumulative and the pursuit of any particular remedy shall be without prejudice to On the Fly Pest Solutions, Inc.’s rights regarding any other remedies.
Notice of Claims to access Premises:
Customer must make premises available for treatment and/or inspection. Failure to do so shall nullify On the Fly Pest Solutions, Inc.’s duties and responsibilities under this Agreement.
Damage Disclaimer:
On the Fly Pest Solutions, Inc. shall not be responsible for any past, existing or future damage to structure(s) referenced above in this contract, except through gross negligence.
Transferability:
On the Fly Pest Solutions, Inc. must be notified in writing within 30 days upon transfer of ownerships of the structure(s). On the Fly Pest Solutions, Inc. agrees to transfer service agreement to new owner if customer agrees to the same terms and conditions, allows inspection of the property and account is in good standing. Failure to notify On the Fly Pest Solutions, Inc. of a sale shall constructively terminate this Agreement, at On the Fly Pest Solutions, Inc.’s sole option.
As consideration for the agreement, Customer waives all claims for damages to property or person(s) which may result indirectly from work performed by On the Fly Pest Solutions, Inc., other than in the event of gross negligence on the part of On the Fly Pest Solutions, Inc. This agreement provides for treatment or retreatment of structure but does not provide for repairs or damage caused by wood destroying organisms.
I affirm that I understand that On the Fly Pest Solutions is not liable for hidden damage which is concealed, obstructed, or inaccessible to the inspector.
Terms and Conditions:
Customer allows On The Fly Pest Solutions access to their property annually to renew the warranty and check stations.
This agreement shall be for an initial period of one year, and will renew itself on an annual basis for a period of 1 year, unless customer cancels this agreement with 30 days written notice prior to the renewal date. If client does not satisfy the terms of contract upon request of cancellation, cancellation may only be finalized after all open balances on the customer’s billing account have been paid in full and the client has paid an early cancellation fee of $150. Upon cancellation, customer grants On The Fly Pest Solutions to access the property during standard business hours and remove all the stations which are property of the On The Fly Pest Solutions. Customer waives all liability or claims for damages to property or person(s) which may result from On The Fly Pest Solution’s removal of said stations, or entry upon Customer’s property. If On The Fly does not receive proper notice or access to collect the stations, customer agrees to reimburse On The Fly for the cost of the stations. The initial deposit of 50% payment is due upon execution of this agreement. On the Fly Pest Solutions, Inc. reserves the right to suspend service or cancel this agreement for any reason, at any time.
A $35 fee will be imposed for any check dishonored by Customer’s bank. A 1.5% re-billing fee will be imposed for each month that an account remain delinquent. In the event that any account is referred to collection, Customer shall be responsible for all costs of collection including, but not limited to, reasonable attorney’s fees whether or not suit is commenced. On the Fly Pest Solutions, Inc. reserves the right to increase any subsequent year’s contract price on 30 prior notice to Customer.
CUSTOMER MAY CANCEL THIS AGREEMENT WITHIN THREE BUSINESS DAYS AFTER SIGNING AGREEMENT
