COVERED SERVICES: This agreement is being made between Customer and On The Fly Pest Solutions, Inc. Services to be rendered include quarterly service visits to the Customer’s home to plan and implement an Integrated Pest Management (IPM) program. Covered pests include roaches (German, Oriental, American, and brown-banded), ants (house, odorous, pavement, and Argentine), box elders, carpet beetles, centipedes, clover mites, house and cave crickets, earwigs, millipedes, silverfish, spiders (house, wolf, hobo, and cellar spiders), mice (house and field), and rat prevention. Pest control services reduce risk but do not guarantee that pests will never return or that all pests will be eliminated.
Service dates are estimates and may be rescheduled due to weather conditions, safety concerns, or other circumstances beyond On The Fly Pest Solutions’ reasonable control. Stinging insects including hornets (bald-faced and European), bumblebees, umbrella wasps, mud daubers, and yellow jackets will be controlled up to 25 feet in height directly on the main structure. Nests located inside the structure are not included and may require an additional fee for removal.
ADDITIONAL PREVENTIVE SERVICES (OPTIONAL): Mosquito prevention services are intended to reduce mosquito activity but do not eliminate mosquitoes or prevent all mosquito bites. Effectiveness depends on weather, standing water, environmental conditions, and surrounding properties beyond the company’s control. The company does not guarantee prevention of mosquito-borne illness or disease. Mosquito services are seasonal, and effectiveness may diminish between treatments. Termite preventive services do not guarantee the absence of termites and do not include repair or coverage for termite damage. Discovery of termite activity does not obligate the company to provide treatment under this agreement.
SAFETY NOTICE: Technicians can only service safely accessible areas. All products used by On The Fly Pest Solutions, Inc. are EPA compliant and applied in accordance with federal, state, and city regulations. The customer is responsible for notifying the company in advance of any allergies, sensitivities, medical conditions, or special concerns relating to occupants or pets.
NON-COVERED SERVICES: On The Fly Pest Solutions, Inc. provides control measures only for pests listed as covered under this agreement. Management of additional pests, such as bed bugs, is available as a separate service. Termite preventive services, if elected, are limited to monitoring and preventive measures only. Any termite treatment, remediation, or damage repair requires a separate written termite agreement.
LIMITATIONS OF LIABILITY: On The Fly Pest Solutions, Inc. is not responsible for any past, present, or future damage to structures or contents caused by wood-destroying organisms or insects, whether visible or hidden, nor for any costs incurred as a result of such damage. The company is not responsible for damage to landscaping, plants, lawns, or soil conditions unless caused by gross negligence or willful misconduct and is not liable for repairs or replacement of structural damage. This contract does not cover replacement or repair of termite, pest, or insect damage and provides remedial treatment only. For mosquitoes or termites, coverage is limited to preventive and maintenance services.
Pest activity may be influenced by conditions outside the property, including neighboring structures, shared walls, construction defects, or environmental factors for which the company is not responsible. The sole remedy under this agreement is re-treatment of the property. The customer releases and agrees to indemnify and hold harmless On The Fly Pest Solutions, Inc. from any obligation to repair or pay for damages.
CUSTOMER COOPERATION: The customer must provide safe and reasonable access to treatment areas and secure pets as needed. Missed or incomplete service due to lack of access, unsafe conditions, or customer unavailability is not considered a service failure. Conditions conducive to pest activity identified in writing by the company must be corrected by the customer, or satisfactory service cannot be assured. Failure to correct such conditions voids all guarantees and may require additional paid treatments. The customer authorizes the company to document service conditions, including photographs, for service records and quality assurance purposes.
PESTICIDE LABELS: Upon request, On The Fly Pest Solutions will provide copies of manufacturer specimen labels for pesticides used to treat the structure. Labels are also available on the company website.
OWNERSHIP OF CONTROL DEVICES: All control devices used at the property remain the property of On The Fly Pest Solutions, Inc. Upon expiration or termination of this agreement, the company is authorized to retrieve all control devices.
BINDING ARBITRATION: Any dispute arising out of or relating to this contract shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. By agreeing to arbitration, the parties waive their right to trial by jury. Judgment on an arbitration award may be entered in any court of competent jurisdiction.
ENTIRE AGREEMENT AND TERMS: This contract constitutes the entire agreement between the parties and applies only to the listed customer and service address. It may not be transferred without written consent and is governed by the laws of the state of Maryland. The agreement renews annually unless canceled with at least 30 days’ prior written notice and submission of a cancellation form. Early cancellation may require a $150 fee if contract terms are not satisfied. The company reserves the right to suspend or cancel service at any time, and payment obligations, liability limitations, and dispute resolution provisions survive termination.
A $35 fee will be charged for dishonored checks, and a 1.5% monthly rebilling fee applies to delinquent accounts. If an account is referred to collections, the customer is responsible for all associated costs, including reasonable attorney’s fees. The company may increase contract pricing with 60 days’ prior notice. The customer agrees to contact the company in good faith to resolve billing concerns before initiating any credit card chargeback.
